Welcome to GPSafe. These Terms & Conditions (the "Terms") govern access to and use of the mx.gpsafe.io website, its forms, content and the telemetry, tracking, dashcam, reporting, mobile app and API services offered by GPSafe (the "Services").
1 Definitions
- GPSafe / "we": GPSafe Telemática S.A. de C.V., domiciled in Querétaro, Mexico.
- User / "you": any person accessing the site or contracting the Services.
- Customer: user with an active commercial agreement with GPSafe.
- Platform: the suite of software and APIs available at platform.gpsafe.io.
- Devices: hardware (GPS, dashcam, sensors) installed in Customer vehicles.
2 Purpose of the site
This site is informational and commercial: it presents our products, allows you to request demos, quotes and support, and describes available Services. Actual Service contracting is formalized through a separate commercial agreement.
3 Intellectual property
All site content (text, graphics, logos, icons, images, source code, software, databases, trademarks and design) is the property of GPSafe or its licensors and is protected by applicable Mexican and international law.
Reproduction, distribution, modification, public communication or any other exploitation without prior written authorization is prohibited.
4 Acceptable use
When using the site or Services, you agree NOT to:
- Gain unauthorized access to systems, accounts or third-party data.
- Reverse-engineer, decompile or disassemble the software.
- Launch attacks (DDoS, mass scraping, fuzzing) against our infrastructure.
- Use the Services for unlawful purposes or to infringe third-party rights.
- Impersonate any other person or entity.
5 Service contracting
Services are contracted via signed commercial proposal and are governed by each customer's specific agreement, which sets pricing, scope, SLAs, payment terms, duration and special conditions.
Unless otherwise agreed:
- Prices are quoted in Mexican pesos (MXN) plus VAT.
- Billing is monthly and payment is due within 15 calendar days.
- Late payments may result in Service suspension.
6 Online payments (Stripe)
When enabled, online payments are processed by Stripe Inc., a PCI-DSS Level 1 certified payment processor. GPSafe does not store full card data. Stripe's terms apply to your transaction.
7 Availability & SLA
We make best efforts to keep the Services available 24/7 targeting 99.5% monthly uptime (excluding maintenance windows). Where a contractual SLA applies, the penalties and credits described in the Customer's contract govern.
8 Limitation of liability
GPSafe shall not be liable for indirect damages, loss of profits, loss of data or any consequence arising from:
- Service interruptions due to external causes (network providers, electricity, force majeure).
- Misuse of the Service by the Customer or its operators.
- Decisions made based on information derived from the Platform.
In any event, GPSafe's maximum liability is limited to the amount paid by the Customer during the 3 months prior to the event giving rise to the claim.
9 Privacy & data protection
Processing of personal data is governed by our Privacy Notice.
10 Third-party links
The site may include links to third-party sites. GPSafe does not control nor is responsible for their content, policies or availability.
11 Changes
We may modify these Terms at any time. The current version will always be the one published on this page. Continued use of the site after an update implies acceptance of the new Terms.
12 Governing law & jurisdiction
These Terms are governed by the laws of the United Mexican States. Any dispute shall be resolved by the competent courts of the city of Querétaro, Mexico, the parties waiving any other jurisdiction that might otherwise apply.
